B.C. Expropriation Association Fall Conference, 2020: A Primer on Ancillary Rights

Evan Cooke will be presenting at the B.C. Expropriation Association’s Annual Fall Conference on October 23^rd, 2020.

The presentation, “A Primer on Ancillary Rights”, will introduce attendees to the practice of creating legal burdens on land ancillary to rights strictly contained within a surveyed right-of-way or easement area. The practice is a matter of convenience for the benefiting party, but raises questions of enforceability, creates complications for valuation, and leads to inevitable conflict where expropriation compensation is concerned.

The presentation will be made jointly with Aurora Kaulkner-Killam of Cox Taylor (lawyer) and Craig Hennicar of Colliers International (real estate appraiser).

Evan Cooke has been the President of the B.C. Expropriation Association since 2013.
