Ludwiczak v. Nguyen, 2020 BCSC 1202. Counsel for the defendants in a personal injury matter arising from a car accident. The plaintiff, a security guard, sought damages in excess of $370,000 based primarily on complaints of chronic back pain. The major issue in dispute was whether the plaintiff’s employability had been significantly curtailed because of his back injury. The Court accepted many of the defence arguments, including that the plaintiff’s loss of income-earning capacity was modest and unlikely to persist until the age of 65. Ultimately, the court awarded the plaintiff less than half of the amount of total damages claimed.
